Government procurement support green building materials to promote building quality improvement policy project implementation guide
Chapter I General Provisions
Article 1 In order to promote the implementation of the policy of government procurement to support green building materials to promote building quality improvement, in accordance with the ''Notice of the Ministry of Finance, the Ministry of Housing and Urban-Rural Development, the Ministry of Industry and Information Technology on Expanding the Scope of Implementation of the Policy of Government Procurement to Support Green Building Materials to Promote Building Quality Improvement "(Treasury [2022] No. 35), combined with the current national laws, regulations and technical standards on green buildings, energy conservation and green building materials.
Article 2 This guide is applicable to the relevant activities of the whole process of feasibility study preparation, design and review, government procurement, construction, testing, acceptance, and third-party (pre) evaluation of construction projects that are included in the implementation scope of the government procurement support green building materials to promote building quality improvement policy, including hospitals, schools, office buildings, complexes, exhibition halls, exhibition centers, gymnasiums, affordable housing and other government procurement projects (including government procurement projects applicable to the bidding law).
Article 3 Purchasers 1 and relevant parties included in the scope of policy implementation shall refer to this Guide for implementation. 1 Including the third-party construction agency entrusted by the purchaser.
Article 4 The competent departments of urban finance, housing and urban-rural construction, industry and informatization (economy and informatization), natural resources, market supervision, and government services that are included in the scope of policy implementation shall refer to this guide and do a good job in project-related projects in accordance with the division of responsibilities. Approval, procurement and supervision work.
Article 5 The construction projects included in the scope of policy implementation shall not only comply with the provisions of this Guide, but also comply with the provisions of relevant national, local and industry laws, regulations and standards.
Chapter II Feasibility Study
Article 6 The project proposal shall specify the target value of the green building star, the application proportion of green building materials and the assembly rate of the project.
Article 7 To prepare a feasibility study report, a special article on green buildings and green building materials shall be prepared on the initiative in accordance with the Government Procurement Demand Standards for Green Buildings and Green Building Materials (hereinafter referred to as the Demand Standards), including but not limited to the following contents:
(I) project green building and green building materials application overview, preparation basis, relevant green planning and construction conditions;
(II) green building star targets, main measures and relevant professional construction requirements;
(III) green building materials application rate target, main measures and related professional construction requirements;
(IV) the assembly rate target value, full decoration requirements, main measures and relevant professional construction requirements of the assembly project.
Article 8 The preparation of project investment estimates shall take into account the incremental costs related to green buildings and green building materials and the cost savings of bulk centralized procurement of green building materials, including the following:
Star incremental cost of (I) green building;
The incremental cost of (II) the high performance requirements of green building materials (green requirements and quality attribute requirements), which can be prepared by inquiry or by reference to the price and tax standards of the material and equipment catalogue if conditions are met;
Expenses (III) the application, testing and third-party (pre-) evaluation of new processes, new technologies, new materials and new equipment;
(IV) the incremental cost of using technology such as assembly construction and full decoration;
The actual cost of (V) general-purpose green building materials after the implementation of bulk centralized procurement.
Article 9 When the competent department of urban investment included in the scope of policy implementation reviews the feasibility study report according to the corresponding process, it may invite experts related to green buildings, green building materials and prefabricated buildings to review the green buildings and green building materials chapters in the feasibility study report and reflect them in the review conclusions.
Chapter III Design and Review
Article 10 In the project design stage, a list of the use of green building materials shall be prepared, and the proportion of the application of green building materials in green buildings shall be accounted. The accounting method can be refined on the basis of the current Green Building Evaluation Standard (GB/T50378). If the relevant policies or standards are adjusted, the latest policies or standards should be implemented.
Article 11 The engineering design results documents shall include technical specifications, which shall specify the index requirements for green building materials such as structural materials and components, building decoration materials, equipment and facilities.
Article 12 The design unit shall carry out project design according to the actual situation of the project and against the requirements of the Requirements Standard and other specifications.
The construction drawing review agency shall, in accordance with the agreement of the drawing review contract, conduct a pre-evaluation of the green building and assembly building of the project and issue a pre-evaluation report. For projects that do not require review of construction drawing design documents, the design unit shall issue a letter of commitment to the purchaser that the design documents meet the Requirements Standard.
Article 13 In the scheme design stage, the design and planning of green buildings and green building materials shall be carried out in accordance with the Demand Standard, which mainly includes the following contents:
(I) planning and construction conditions, green building star grade positioning and green building materials application overall strategy;
(II) construction methods and structural forms of construction projects;
Construction requirements of (III) architecture specialty;
Requirements for (IV) structure specialty construction;
(V) HVAC professional construction requirements;
Requirements for (VI) water supply and drainage specialty construction;
(VII) electrical professional construction requirements.
Article 14 In the preliminary design stage, the design result document shall specify the main design application contents and technical parameters of green buildings and green building materials, and shall also include the following green design contents:
(I) green planning and construction conditions, green building star rating requirements, in which the star rating should be in accordance with the corresponding city's green building special planning and "green building evaluation standards" (GB/T50378) and other relevant requirements are clearly defined;
(II) the construction mode and structure form of green building project;
(III) the construction requirements, design content and basic requirements of green building materials and decoration materials for the architectural specialty;
Construction requirements of (IV) structure discipline, design content and basic requirements of green structural materials and components;
(V) HVAC professional construction requirements, design content and basic requirements for green functional equipment and facilities;
(VI) the construction requirements, design contents and basic requirements of green functional equipment and facilities for water supply and drainage discipline;
(VII) the construction requirements, design contents and basic requirements of green functional equipment and facilities for electrical specialty;
(VIII) green building and prefabricated building pre-evaluation form, green building materials application ratio calculation sheet.
Article 15 In the construction drawing design stage, the design result documents shall specify the main design contents, parameters and specific structures and measures of green buildings and green building materials in accordance with the Demand Standard, and review and deepen the relevant contents obtained in the approval of government departments in the previous stage. The design section shall include the following contents:
(I) construction methods and structural forms of construction projects;
(II) the construction requirements, design contents and decoration materials of architectural specialty;
Construction requirements, design contents, structural materials, components and fittings of (III) structures;
(IV) HVAC professional construction requirements, design contents and equipment and facilities requirements;
(V) the construction requirements, design contents and equipment and facilities requirements for water supply and drainage discipline;
Construction requirements, design contents and equipment and facilities requirements of (VI) electrical discipline;
(VII) Green Building Self-Rating Form;
(VIII) green building materials application summary table.
Article 16 The purchaser shall entrust the construction drawing review agency to evaluate whether the construction drawing design documents implement the Demand Standard. For projects that do not require the review of construction drawing design documents, the purchaser shall submit a letter of commitment to implement the Demand Standard to the construction administrative department before going through the construction permit formalities node.
Chapter IV Government Procurement
Article 17 When the purchaser organizes the preparation of the bill of quantities and the maximum price/tender control price for government procurement, it shall incorporate the relevant requirements of the Demand Standard, including the implementation cost of green buildings and green building materials. For the unclear construction drawings, the purchaser shall promptly organize the design unit and the preparation unit to communicate and form a written document.
Article 18 The preparation of procurement documents (including project bidding documents) and the drafting of contract texts shall meet the following requirements:
(I) According to different procurement types, such as design, construction or general contracting (EPC), the corresponding green building evaluation level, construction requirements and green building materials procurement (bidding) requirements shall be clearly defined in the procurement documents and proposed contracts in accordance with the Requirements Standards;
The (II) that "the requirements of the construction works and the performance of the materials meet the relevant requirements of the Requirement Standard" shall be regarded as the substantive requirements of the procurement documents and shall be clearly identified in the conditions for invalid or rejected bids;
In drawing up the model contract, the (III) shall specify the green building grade, application proportion and assembly rate of the project according to the requirements of the procurement documents, and take the relevant requirements of the Requirements Standard as substantive clauses;
In the (IV)'s proposed construction contract, it must be clear that the project contractor shall purchase and use all green building materials that meet the "Demand Standard" if it involves the use of green building materials in the "Demand Standard.
Article 19 In the procurement documents and the proposed contract, the green building materials supplier shall be required to provide one of the following supporting documents as the basis for verification when participating in the procurement activities:
(I) provide green building materials test reports that meet the requirements of the relevant indicators of the Demand Standard;
(II) provide green building materials product certification in line with the relevant indicators of the "demand standard;
(III) the indicators specified by the enterprise in the Demand Standard, the supplier may only provide the enterprise commitment letter.
Article 20 the financial departments of the people's governments of cities divided into districts and autonomous prefectures or above shall, in accordance with the actual needs of the projects included in the scope of policy implementation and the actual production of green building materials suppliers, comprehensively consider the versatility, standardization, amount and consumption of building materials, study and determine the types of general-purpose building materials for batch centralized procurement and formulate the implementation plan for batch centralized procurement.
Article 21 The purchaser shall sort out the application quantity of green building materials included in the scope of batch centralized procurement, organize the application quantity of green building materials centralized procurement, and submit it to the financial department and the government centralized procurement institution (department centralized procurement institution) before the construction bidding. Government centralized procurement agencies (departmental centralized procurement agencies) prepare procurement documents, organize procurement activities, and implement batch centralized procurement in phases and batches in accordance with relevant government procurement laws and regulations, implementation plans for batch centralized procurement of green building materials, etc.
Article 22 After determining the winning bid and closing supplier, the purchaser, construction unit (or general contractor) shall sign the "Green Building Materials Procurement and Supply Contract" with the winning bid and closing supplier within the prescribed time limit, and strictly apply the results of centralized bulk procurement of green building materials.
Article 23 Encourage the promotion of electronic procurement transactions of green building materials, and all eligible green building materials products can be traded on the electronic platform to improve the efficiency and transparency of green building materials procurement.
Chapter V Construction
Article 24 The purchaser shall improve the quality management system of the project. The project leader of the purchaser shall, as the first responsible person, assume the primary responsibility for the organization and management of the policy implementation of the project, and designate full-time personnel to clarify the quality management responsibilities of the procurement and use of green building materials. Professional institutions or personnel can be employed if they do not have the conditions.
Article 25 The construction unit shall carry out the construction in strict accordance with the provisions of the design documents and the requirements standards, as well as the relevant construction standards. The construction unit shall establish the corresponding construction management system and organization, and determine the person responsible for the application of green buildings and green building materials.
Article 26 The supervisory engineer stationed on-site supervision shall have the professional knowledge and management ability related to green buildings and green building materials, be familiar with the "Demand Standards", and fully grasp the relevant contents agreed in the design documents and construction contracts.
Article 27 Before the commencement of the project, the purchaser shall organize a special joint review in accordance with the relevant contents of green buildings and green building materials in the design documents, and carry out the design disclosure and form a written summary. The design unit shall actively provide relevant technical standards and assist and guide the construction unit in the construction of new technologies, new materials, new processes and new equipment.
Article 28 The construction unit shall establish a special ledger for the entry of green building materials, which includes but is not limited to the product name, specification and model, product quantity, purchasing unit, manufacturer, quality certification document number (including certification certificates for green building materials and other certification materials), entry time, entry re-inspection report, etc.
Article 29 The construction unit shall carry out self-examination and self-correction in three stages: foundation and foundation, main structure, decoration and installation, and focus on checking whether the relevant contents of green buildings and green building materials to be completed in this stage have been implemented in accordance with the design documents, and meet the requirements of the "Demand Standards" and other relevant national and local norms and standards, and shall form written documents.
Article 30 Projects included in the scope of policy implementation shall establish special data files on green buildings and green building materials, including but not limited to the following contents:
(I) green building and green building materials corresponding responsibility list;
The (II) shall be sealed by the purchaser, design unit, construction unit and supervision unit.
Confirmed green building and green building materials special review and design disclosure minutes;
The change data of the relevant contents of green building and green building materials occurred during the construction of the (III); the change process shall comply with the relevant requirements of the local industry authority for the change management of the project energy saving system;
(IV) the entry ledger, quality certification documents and quality inspection of green building materials;
(V) green building materials inspection records, project performance acceptance, concealed acceptance records, completion acceptance records, etc;
Summary of (VI) construction implementation.
Article 31 During the construction process, if it is found that the contents of the design documents related to green buildings and green building materials are unclear or wrong, it shall be reported to the purchaser in a timely manner, and the design unit shall make supplements and changes. If major changes are involved, it shall be submitted to the original energy-saving evaluation unit and the construction drawing review organization for review in a timely manner.
When the engineering design is changed, the relevant performance of the green building and green building materials shall not be lower than the requirements of the "demand standard" and other relevant national and local standards.
Article 32 The purchaser, construction and supervision units shall do a good job in the entry inspection of green building materials in strict accordance with the requirements of the construction acceptance specifications, and can only be used on the project site after passing the inspection.
Article 33 Supervision units shall carry out supervision activities in strict accordance with the detailed rules for the implementation of special supervision of green buildings and green building materials. When it is found that the project construction does not meet the relevant quality standards, technical requirements or "demand standards", it shall notify the construction unit in writing to correct. When the engineering design is found to be in violation of the above requirements, the purchaser shall be reported to the design unit for correction.
Article 34 the relevant urban construction administrative departments shall, in combination with the supervision, management and inspection process of the construction process of construction projects, strengthen the supervision and management of the relevant contents of green buildings and green building materials of the project, so as to ensure the smooth progress of the project.
Article 35 The construction administrative department and various industry associations shall actively carry out training for construction, design, construction, supervision, testing institutions and other units in accordance with relevant policy implementation content, technical requirements, work procedures, etc., to ensure full Implementation of policy requirements.
Chapter VI Testing
Article 36 The organization and management of the performance testing of green buildings and green building materials for projects included in the scope of policy implementation shall be the responsibility of the purchaser.
Article 37 The testing institution shall comply with the Measures for the Administration of Quality Testing of Construction Projects (Order No. 57 of the Ministry of Housing and Urban-Rural Development) and pass the qualification accreditation (CMA). The purchaser may give priority to the testing organization with laboratory accreditation (CNAS) qualification. The test methods and test reports shall not only meet the requirements of this guide, but also meet the requirements of current national and local codes and standards.
Article 38 In order to ensure the improvement of construction quality, the purchaser shall, in accordance with the relevant requirements of the Demand Standard, carry out inspection report verification and corresponding physical inspection at the stage of material entry and performance acceptance. The results as an important basis for acceptance.
Article 39 When green building materials enter the site for inspection, the construction and supervision units shall check the quality certification documents, including the certificate of approval, relevant index inspection (testing) report/certification certificate, in which the relevant index inspection (testing) report shall fully describe the name and address of the principal, manufacturer, manufacturer, manufacturer, product name and address, product name, product description, model and specification of the green building materials under inspection, the inspection report shall give the test results of the corresponding index requirements of the Demand Standard and specify whether the corresponding index requirements are met.
Article 40 After entering the site, green building materials shall be re-inspected according to the relevant acceptance specifications of construction projects. The re-inspection samples shall be randomly selected and shall meet the requirements of uniform distribution and representativeness. The construction unit shall strengthen the quality control of the building materials entering the construction site, and the building materials with incomplete quality certificates shall not enter the site.
Article 41 The construction unit and its sampling and inspection personnel shall ensure that the test samples provided are representative and authentic.
Article 42 The witness personnel of the purchaser or supervision unit shall witness the sampling and inspection on the construction site, and shall ensure the authenticity of the sampling and inspection.
Chapter VII Acceptance
Article 43 Before the completion and acceptance, the purchaser shall organize the special acceptance of green buildings, green building materials and assembly construction, form a special acceptance report and be responsible for the acceptance results. The special acceptance report shall at least include the following contents:
(I) green building and green building materials project implementation;
(II) relevant material re-inspection and site physical inspection;
(III) application proportion calculation of green building materials;
(IV) assembly rate calculation report.
Article 44 If the acceptance results of green buildings, green building materials and assembly rate are unqualified, the completion acceptance shall not pass.
Article 45 The project included in the scope of policy implementation shall apply for obtaining the corresponding star-rated green building logo after the completion acceptance.
Article 46 For projects included in the scope of policy implementation, the proportion of project progress payment shall not be less than 80% of the completed project price.
Article 47 To implement the settlement of the construction process, the contracting parties shall, through the contract agreement, divide the construction process into the construction cycle on time or progress nodes, and calculate, confirm and pay the price of the completed and undisputed works within the cycle. The process settlement documents confirmed by both parties are part of the completion settlement documents, and will not be reviewed repeatedly in principle after completion.
Chapter VIII Supplementary Provisions
Article 48 Cities (municipal districts) that are included in the scope of policy implementation may formulate implementation measures in accordance with these Guidelines and in the light of actual conditions.
Article 49 This Guide shall be interpreted by the Ministry of Finance in conjunction with the Ministry of Housing and Urban-Rural Development and the Ministry of Industry and Information Technology, and shall come into force on the date of issuance.
